
Terms Of Service

By commissioning me (Jay/critterskitters, referred to as 'I', 'me') for any of my services, you (the client) accept these terms of service - if you do not agree with these terms, do not commission me, as you will be held to these terms and conditions throughout the commission process. I encourage any questions and discussion of what these terms mean before you agree to them! These terms pertain to my digital artwork and merchandise.
Pricing
My prices are listed in USD, and I accept payment in either USD or NZD - if paying in NZD, the price will be calculated at the time of purchase based upon the current exchange rate.

I accept payment via PayPal or bank transfer (direct debit). Direct debit payments are only available for clients who have a New Zealand bank account.​
​
I do not hold commission 'slots' as I don't tend to take a capped number of commissions, excluding in the cases of YCHs (your character here) seasonal promotions or limited time sales, which I will hold for 48hrs (or longer if discussed).
​
I take payment when I start working. When I am ready to begin your piece I will notify you for payment - this is sometimes upfront and depends on my queue, which you can check here. Once payment is received I will start the piece.
Payment for auctions MUST be sent in 48hrs of the auctions end. If you fail to pay on this timeframe, I'll consider it cancelled and readvertise the piece. Exceptions may be made on a case by case basis, please discuss if you need a further hold.

Payment plans are available for orders over $30 USD. You may pay a minimum of 1/3 increments, either weekly, fortnightly OR 1/3 upfront, 1/3 to begin linework, and 1/3 to begin colour/render - payment before each step of the work continues, at your pace.
For pieces over $100 USD, payment plans may be paid in smaller increments or longer payment schedules, to be discussed between myself and the client.
Any payment plans will be discussed and agreed upon before you are invoiced, in a private message or email.

Refunds and Disputes
Note;
​I will keep all of our correspondence during the commission process, including emails, invoices and other text based communication. The client is encouraged to keep the same record so that it is accessible in the event of a dispute.
I do not offer refunds of custom digital artwork once the flat colour is completed. Full refunds are available before I start working, or a partial refund if I have started (up to 60% of what you paid depending on the level of completion.)

If I decide I cannot complete a commission, you will be refunded the full amount.

A refund can be requested for any non-custom digital artwork (eg a premade character design) up to 30 days after the purchase date, after this window a refund can not be guaranteed.

A refund can be claimed for any physical artwork/merchandise in the case it arrives damaged or incorrect. In this case, the item/s are required to have been shipped back to me before a refund will be issued - shipping costs will be covered by me.

What You Receive and Wait Time
​
Digital commissions will be completed within one to two months, or by a set date (in the case of seasonal YCHs or if set by myself and the client).

I will send you WIPs (works in progress) at the sketch, line art, flat colour and render (if applicable) stages. WIPs are sent through google drive, you'll receive a link to the folder and all WIPs will be uploaded into that folder, and I will notify you when a new WIP is uploaded either by DM or email.
You may request edits on any WIP, though large edits once the piece is lined may come with an additional fee.*
*the amount for an additional edit fee varies based on the scale of work and will be discussed on a case by case basis.
I'm happy to make small edits to your completed piece within a year of it being finished, excluding seasonal YCHs.

WIPs and all finished art is sent as a .png file available as a digital download through google docs or emailed directly to you, this is the final product you receive.

Physical items being shipped may take up to a two months depending on where the item is being shipped to.
I personally ship my products from New Zealand.

Physical items are sent out with a tracking number, I do not have control of the package once it has shipped.
Shipping cost is calculated before payment, and is sent through NZ Post. Any additional fees outside of postage, such as duty fees or other import or customs fees, are the clients responsibility.

Art Use and Client Agreements
​
Download the final piece from google drive so you have free access to the final piece, especially if the piece has variations or alternate versions. I can resend files and do keep my work on a hard drive if you forget or lose it. I also encourage you upload to sites like toyhou.se and dropbox for character storage!**

The commissioner is purchasing rights to slight modifications, use and display of the artwork commissioned under the creative commons license for personal use. This means the client may post to their own sites and pages, upload to a character storage such as toyhou.se and otherwise display/use the completed artwork for personal use only. Modification of any commissioned art piece must remain at least 60% recognizable as the completed commission ***

***Commissioned art may be cropped to use as banners and icons/avatars, and you may add your own watermarks to the image. The final piece can be lightly edited within 60% of the original piece remaining recognizable. Commissioned art can not be used for commercial purposes, even by the person that bought the commission, as I do not sell commercial rights to my art as of Jan 2025.

The client may print or otherwise use commissioned digital media to create physical items for personal use or to give away for free.
​
I retain the rights to my intellectual property (IP) and copyright under the creative commons license, and retain rights to upload to my own sites and galleries or use as examples of my previous works or to otherwise advertise for new commissions at any time. At no point does the client receive the copyright to the commissioned piece, and at no point should the client claim the artwork as their own IP. ****

****Please note; Intellectual property refers to the ownership of the intangible property that is the result of creativity - this does not refer to the rights to reproduce, edit, modify, or otherwise use for personal use, but instead refers ownership of the copyright. When a client commissions me, they buy the right to display, modify and use the artwork for personal use as part of their commission, but at no point does the client receive copyright or rights to the IP as part of the sale.

Private Commissions
​
I take private commissions. At the time of commissioning me or requesting a quote, simply state you'd like the commission to be private.
​
Private commissions are still included in my queue, listed as 'private commission'. All details and identifying information such as character refs and usernames will not be included, and will instead be saved to my desktop for my use and then removed once the commission is completed. This option is available if privacy is important for you, or if you intend for something to be a gift, so it is not publicly visible on my queue to the recipient.

Private commissions can either be posted***** or kept private, the choice is up to the client.
​
***** Private commissions as surprises/gifts may be posted after the date of the occasion/gifting if the client chooses. No private commission will be posted without permission from the client.

Commercial Licensing
​
I no longer offer commercial licensing of my work, as of Jan 2025. All previously licensed work still abides by the contract agreements at the time of licensing.

Additional Notes

I do not mind if my work is traced or referenced for the purposes of learning or personal use. I prefer pieces recoloured, traced or copied directly from my work either remains private or is posted with credit to the original piece and explicitly stated how it was used (traced, referenced etc).

Please do not repost my work without permission, unless it is work you have personally commissioned.
